Without getting into discussion that women rights protection bill is Islamic or not there was something I simply couldn’t digest. During his address to Nation, president musharaf tried to define “zina-bil-jabar” (rape) and zina-bil-razaa. He went like this, zina-bil-jabar: when a man rapes woman and the woman goes to police station……… Zina-bil-razaa: when a woman rapes a man and……..
I mean seriously is it something wrong with my senses or is it that I am actually ignorant of the exact definition cause to me both sound like zina-bil-jabar(please correct me if I am wrong). Was it some mixup or is it really that the people supporting the bill don’t even know where do these terms stand in dictionary.
At the end I’ll leave this on you to decide, following is an extract from the constitution.
Zina/ zina-bil-razaa
A man and a woman are said to commit ‘Zina’ if they willfully have sexual intercourse without being validly married to each other.
zina-bil-jabar
A person is said to commit zina-bil-jabar if he or she has sexual inter-course with a woman or man, as the case may be, to whom he or she is not validly married, in any of the following circumstances, namely:-
(a) against the will of the victim;
(b) without the consent of the victim;
(c) with the consent of the victim, when the consent has been obtained by putting the victim in fear of death or of hurt; or
(d) with the consent of the victim , when the offender knows that the offender is not validly married to the victim and that the consent is given because the victim believes that the offender is another person to who the victim is or believes herself or himself to be validly married.
